ENFORCEMENT ACROSS EUROPE
In 23 EU countries, consumer complaints on the content of marketing communications with the national self-regulatory codes are dealt with by the local Self-Regulatory bodies. National SROs and equivalent body in Denmark are uniquely qualified to deal with complaints about alleged breaches of the codes, as they can fully assess and understand the national context and local sensibilities. There is no self-regulatory enforcement mechanism yet in place in Cyprus (coming before end of 2011), Malta, Estonia and Latvia.
In case of cross border complaints, an appropriate mechanism has been running within EASA for over 15 years.
In case of consumer complaint on your marketing, you are invited to provide all the relevant information requested by the SRO and to comply with the decision taken as much as you would with a court decision.
